2． 状语的翻译

①目的状语

国际条款用语中的目的状语一般由in order to，for the purposes of，so as to，so（such）that引导，可以坐落于句首，也可以坐落于句末。其所在的地方取决于它传递的信息在条款内容中的重要程度和目的状语的结构。一般目的为次要信息或者目的状语含有多个平行结构，行文时以坐落于句末为主。比如：

The General As百度竞价推广bly shall initiate1 studies and make recommendations for the pruposes of：

A． promoting international co-operation in the political field andencouraging the progressive development of internatonal law and its codification2；

B. promoting international co-operation in the econimic，social，cultural，educational，and health fields，and assisting in the realization3 of human rights and fundamental freedoms for all without distinction as to race，sex，language，or religion。

句中for the purposes of引导的目的状语含有两个平行结构，而句子的主干部分相对短小，若翻译时把目的状语放在前面则有头重脚轻的感觉，不如用以字把状语拖后：

联合国大会应发起研究并做成建设以促进：（甲）政治上之国际合作，并倡导国际法之渐渐进步编纂。（乙）以促进经济、社会、文化、教育及卫生多部门之国际合作，且不分种族、性别，语言或宗教，助成全体人类之人权及基本自由之达成。

大家来看另外一个例子：

For the purposes of paragraph 1

the initialling of a text constitutes a signature of the treaty when it is established that the negotiating states so agreed

（b）the signature ad referendum of a treaty by a representative，if confirmed by his state，constitutes a full signature of the treaty。

此句中的目的状语简练短小，可以就用就字把其放于句首：

就适用第一项而言：（甲）倘经确定谈判国有此协议，约文之草签构成条款之签署；（乙）代表对条款作核准之签署，倘经其本国确认，即构成条款之正式签署。

下面一个句子大家就有多个选择：

The General As百度竞价推广bly may establish such subsidiary organs as it deems necessary for the performance of its functions。

此句中，状语比起句子主干部分不大不小，那样句首、句中、句末大家都可以选择：1 为行使其职务，联大可以设立必需之辅助机关；2 联大为行使其职务，可以设立必需之辅助机关；3 联大可以设立必需之辅助机关以行使其职务。

②方法状语

为了防止导致歧义，方法状语一般放于它所修饰的动词之前或之后，由副词或介词短语来充当，结构上有些比较简短，有些比较冗长。方法状语一般都是规定性的，用途是规定条款各方履行义务或行使权力时需要采取的方法或方法。因此，方法状语有时尽管简单，但用途却比较要紧。下面的例1、

A treaty shall be interpreted in good faith in accordance with the ordinary meaning to be given to the terms of the treaty in their context and in the light of its object and purpose。

此句的方法状语相当冗长，但为了体现其语用特点---条款约文的严密性和庄重性，大家还是要把方法状语放在动词之前：条款应依其用语按其上下文并参照条款之目的及宗旨所具备之一般意义，善意讲解之。为了句子的连贯和顺畅，大家把in good faith放得离动词更近。

另外一个更为典型的例子：

The Security Council shall encourage the development of pacific settlement of local disputes through such regional arrangements or by such regional agencies either on the initiative of the states concerned or by reference from the Security Council。

此句中的方法状语占全句比重十分大，因为汉语方法状语地方较为固定，若直接把冗长的方法状语译成中文有时十分困难。遇见这样的情况，大家可以进行转换，把长状语转换成并列句来处置。该句可译为：安全理事会对于依地区方法或由地区机关而求地方争端之和平解决，不论其系由关系国主动提出，或由安全理事会提交者，应鼓励其进步。

③条件状语

条件状语的状况比较复杂，有表假设的条件状语，有表先决条件的条件状语，还有表示例外状况的条件状语。引导条件状语的词汇有if，unless，except，subject to，in case，provided（that）等等，所以在翻译中不可以偏概全，针对不一样的条件状语要采取不一样的翻译方法
